Course Description

This program provides a practical, focused certification on the procedures and legal principles governing the settlement of disputes within the multilateral trading system, primarily focusing on the World Trade Organization (WTO) Dispute Settlement System (DSS). The course thoroughly examines the Dispute Settlement Understanding (DSU), which is the foundational agreement outlining the rules and procedures for resolving trade conflicts between WTO Members.

Participants will gain expertise in the various stages of the DSS, including consultations, the role and function of Panels and the Appellate Body, and the critical processes of adoption of reports and implementation of rulings. The curriculum also covers key issues related to compliance and the authorized use of retaliatory measures (sanctions) when a member fails to implement a ruling. Furthermore, the course will briefly address other forums for trade dispute resolution, such as investor-State dispute settlement (ISDS) and mechanisms in regional trade agreements.
