Course Description

This program offers a specialized certificate designed to provide participants with a deep and critical understanding of the world’s major legal systems and their interaction with International Law. The course moves beyond a single legal tradition (e.g., Common Law or Civil Law) to explore the philosophical foundations, historical evolution, and distinctive methodologies of diverse systems, including: Civil Law (Continental European), Common Law (Anglo-American), Sharia Law (Islamic Jurisprudence), and Socialist/Mixed Legal Systems.

A core component involves comparative analysis of how these different national systems approach and incorporate international legal norms, such as treaty ratification, the role of custom, and the enforceability of international judgments. The program focuses on practical application, addressing how the diversity of legal systems impacts areas like international business transactions, human rights enforcement, and judicial cooperation. By the end, participants will be equipped with the necessary tools to navigate complex legal interactions across national borders and understand the dynamics of legal convergence and divergence in the global sphere.

Course Outcomes

Upon successful completion of this program, participants will be able to:

  1. Identify and distinguish the defining characteristics, historical origins, and conceptual frameworks of the world’s major legal systems (Civil, Common, Sharia, etc.).

  2. Analyze and compare the methodologies used by different legal systems in interpreting legislation, relying on precedent, and determining the admissibility of evidence.

  3. Explain the various approaches to the relationship between national (municipal) law and international law, specifically focusing on the principles of Monism vs. Dualism.

  4. Evaluate the practical impact of legal system divergence on complex international issues, such as contracting, foreign investment, and criminal justice cooperation.

  5. Critically assess the challenges and opportunities in harmonizing national legal frameworks to facilitate global commerce and human rights protection.

  6. Apply comparative legal methodology to research and solve hypothetical legal problems that span multiple jurisdictions.
